Barratry is a type of illegal conduct committed by lawyers. It occurs when an attorney, for their own financial/business benefit, takes actions to encourage a person to pursue legal claims that are unnecessary, useless, baseless or not their idea. Barratry can be incredibly harmful to the client of the lawyer committing it, the target of any frivolous lawsuit and the legal profession itself. At Flores Mendez Law, we are passionate about protecting the integrity of the legal profession and standing up for those impacted by the conduct of unethical personal injury lawyers. Our barratry claims attorneys provide dedicated legal support to barratry victims across southern New Mexico and western Texas.

What Does Barratry Look Like?

Barratry can take many forms. If could involve situations such as:

  • An attorney goes to an accident scene to try to get one of the parties involved to take legal action, regardless of the severity of the crash.
  • A lawyer calls or otherwise directly contacts a person, unsolicited, to talk them into bringing a lawsuit.
  • An attorney tries to drum up business at a hospital by talking to patients without being asked by them to do so.
  • A tow truck driver promotes a particular lawyer or law firm without being asked for their input.
  • A person claiming to have seen the accident offers a ride to a medical provider while also steering the victim toward a specific attorney or firm.
  • A lawyer or an individual urges a victim to sign paperwork that would begin the claims process with them or a law firm.

If a minor accident or incident occurs and a lawyer is trying to get involved when it seems they aren’t needed, barratry may be a possibility. If you suspect barratry, you need guidance and answers you can trust. Our trusted barratry lawyers are ready to address your questions and concerns.

Steps To Take If You Believe You Were Impacted By Barratry

If you suspect you were targeted by barratry, taking organized steps to preserve information can help protect your rights. Evidence is critical in these cases because it can show how the contact occurred, who initiated it and whether the conduct violated the law. The following actions can help you maintain a clear record of what happened before evidence is lost and memories have faded.

  • Save voicemails, call logs and any phone numbers connected to the contact
  • Take screenshots of emails, text messages and social media communications that relate to the interaction
  • Photograph or copy any physical documents, especially if you signed anything under pressure or without a full understanding
  • Write down details about the encounter, including names, dates, descriptions, locations and anything said during the conversation
  • Identify anyone who witnessed the interaction and record their contact information
  • Keep a timeline of events so you can clearly show when each interaction occurred
  • Store all evidence in one place to avoid losing important information
  • Note whether the person mentioned a lawyer, law firm, medical provider or referral service

Taking these actions helps create a clear picture of how the contact unfolded and preserves information that may be essential when assessing potential misconduct. Additionally, keeping thorough records allows an attorney to evaluate the situation more effectively and determine whether the conduct meets the legal definition of barratry.

After you gather the necessary information, our attorneys can evaluate each piece of evidence to determine whether improper solicitation occurred and how it affected your situation. We can explain your legal options, identify potential violations and guide you through the next steps. Our involvement helps ensure that your rights are protected and that any unlawful conduct is addressed appropriately.

An Overview Of Barratry Laws In New Mexico And Texas

Barratry is a criminal offense in both New Mexico and Texas. Texas also has a civil statute related to barratry: Texas Government Code Section 82.065. This law allows individuals who have been wrongfully solicited by an attorney through barratry to seek a variety of remedies, including cancellation of any contract signed, damages, penalties and a clawback of fees.

While New Mexico does not have a similar civil law for suing a lawyer directly for barratry, victims of barratry in the state might still be able to take action under other consumer protection and fraud laws, depending on the exact conduct of the offending attorney.

Our barratry lawyers can help you understand your rights and what particular laws may be applicable in your case.
